Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the amount you paid to us, if any, in the six (6) months preceding the event giving rise to the claim.

11. Choice of Law

These Terms and any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or our services (whether in contract, tort, or otherwise) will be governed by and construed in accordance with the laws of the State of New York, without giving effect to any conflict of law principles that would result in the application of the laws of another jurisdiction.

12. Dispute Resolution; Arbitration; Class Action Waiver

Wrist Enthusiast may require that certain disputes be resolved through binding individual arbitration rather than in court. If arbitration is required, such arbitration will be administered by the arbitration provider specified in the then-current version of these Terms, in accordance with that provider’s applicable rules. To the fullest extent permitted by law, you and Wrist Enthusiast agree that:

  • Any arbitration will be conducted only on an individual basis and not in a class, collective, or representative proceeding.

  • You and Wrist Enthusiast each waive any right to participate as a plaintiff or class member in any purported class, collective, or representative proceeding.

The specific arbitration provider, location, and procedures may be further described in a separate arbitration addendum or in an updated version of these Terms.

13. Changes to the Site and to These Terms

Wrist Enthusiast may update or modify the Site, and may revise these Terms from time to time. When we do, we will post the updated Terms on this page and update the “Last updated” date above. Changes are effective when posted unless otherwise stated. Your continued use of the Site after the posting of revised Terms constitutes your acceptance of those changes.

14. Termination

Wrist Enthusiast may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or for any other reason in our sole discretion. Upon termination, your right to use the Site will immediately cease, but provisions that by their nature should survive termination (including ownership provisions, disclaimers, limitations of liability, indemnity, and choice of law) will remain in effect.
